JDV Fitness LLC — Personal Training Terms & Conditions

Effective Date: July 5, 2025

Summary: By purchasing coaching services from JDV Fitness LLC, you acknowledge that coaching is not medical care, results are not guaranteed, refunds are not offered, and participation is voluntary and at your own risk.

1. Health & Safety

By enrolling with JDV Fitness LLC, you confirm that you’ve consulted with your physician and are cleared to begin an exercise or nutrition coaching program. If any medical conditions, injuries, or health changes occur during your program, please inform Jasmine right away so adjustments can be made safely.

2. Scope of Coaching Program

​Online Coaching (Full Flexibility) is for women who want structure, accountability, and real results, without needing in-person sessions. You’ll get: 

  • Weekly custom workouts delivered via app (with video demos)

  • Custom nutrition plan + grocery list & meal support (flexibility for dietary preferences, restrictions, and lifestyle)

  • Weekly check-ins based on your goals (fat loss, muscle, endurance, habits) that include muscle mass, body fat %, weight, performance so we see a holistic view of progress and can make adjustments

  • Habit tracking every Friday so nothing slips through the cracks

  • Clients must use the Trainerize app and submit progress photos (kept fully confidential unless you provide consent to share)

Nutrition Systems Coaching: This is not a meal plan. It’s a structured system designed to build consistency, reduce decision fatigue, and create sustainable results.

You’ll receive:

  • A personalized meal plan using a MWF / TTh structure for simplicity and routine

  • A full grocery list within your budget (macro breakdown available if desired)

  • Flexibility for dietary preferences, restrictions, and lifestyle

  • Weekly check-ins, every Friday, for accountability, progress review, and adjustments

3. Client Responsibilities

Client agrees to actively participate in the coaching process, follow assigned programming to the best of their ability, communicate honestly about limitations or challenges, and notify Company of any changes that may impact training or nutrition.

4. Weekly Check-Ins

Weekly check-ins are expected to be fully filled out and submitted on time, every Friday at 12pm PT for proper adjustments (if needed) to be made ahead of the new week. Client understands that if check-ins are late, they may not receive feedback until up to 48 hours later.

5. Fees and Refunds 

In consideration for the coaching services provided by Company, Client agrees to compensate Company the amount agreed to on the checkout page. Client shall make payment online through the Company’s client management system.

  • Fees. We reserve the right to adjust pricing for future services or renewals. Current clients will not be subject to pricing changes during an active paid term.

  • Refunds. In order to honor the commitment of our existing and future clients, we do not offer refunds under any circumstances.

  • Recurring payments. You hereby authorize our continued access to your financial information stored in our third party financial processing company referenced in this Agreement until you give a 30 day written notice via email to the Company notifying you are canceling coaching. 

  • Late Payments. If payments are not made on time, you agree to pay interest on all past-due sums at a rate of 1.5% per month, or the highest rate allowed by law, whichever is greater

6. Payments & Packages

To secure your spot, payment must be completed before coaching begins. Payment plans (if applicable) are billed monthly until the balance is paid in full. After three failed payment attempts, sessions will pause until the account is current.

7.  Termination

Either party may terminate this Agreement with 30 days written notice via email. Upon termination, access to coaching services, Trainerize programming, and support will end at the conclusion of the paid period. No refunds will be issued for unused time or services.

8. Intellectual Property

All workout programs, nutrition systems, documents, videos, and materials provided are the intellectual property of JDV Fitness LLC and may not be shared, reproduced, or distributed without written permission.

9. Communication 

Company is generally available to provide services during normal business hours: 8 AM to 4 PM Pacific Time, Monday through Friday and will respond within one business day. Company’s primary source of communication with Client is through Trainerize. 

10. Renewal

If Client wishes to continue coaching with the Company, there is no need to take further action. Client understands that coaching continues on a month-to-month basis unless canceled with 30 days written notice. Client understands renewal is not guaranteed.

11. Service Location

Both parties agree that the coaching services provided will be virtual.

12. Guarantee 

Company does not make any guarantees as to the results, including weight loss, mental or physical health, or other personal gains, of any services provided. Company agrees to provide the services listed in this Agreement in a reasonable and timely manner. Client agrees to take responsibility for Client’s own results.

13. Release and Reasonable Expectations 

Client has spent a satisfactory amount of time reviewing Company’s business and has a reasonable expectation that Company’s services throughout the coaching program will produce different outcomes and results for each Client. Client understands and agrees that: 

  • Every client and final result is different 

  • Fitness coaching is a subjective service and Company may give different information to each Client depending on needs

  • Company will use its judgment to create favorable experiences to each Client, depending on their unique circumstance 

  • Dissatisfaction with Company's independent judgment or coaching style are not valid reasons for termination of this Agreement or request of any monies returned.

14. Disclaimer

Client agrees and understands Company is only a fitness coach, and is not a medical professional or therapist. Nutrition guidance provided is for educational purposes only and does not constitute medical or dietary advice.​ Should Client desire services that exceed the scope of this Agreement, Client must sign a letter of engagement of said professional services with the appropriate service provider. 

Client understands and agrees that neither JDV Fitness, LLC or Jasmine Vallejo may be held liable in any way for any occurrence in connection with my physical fitness and performance or nutrition/diet changes, which may result in injury, death or damages to me or my family, heirs or assignees. I further acknowledge and forever release JDV Fitness, LLC or Jasmine Vallejo​in connection directly or indirectly with my physical fitness training and therapy and nutrition/diet changes as a result of JDV Fitness, LLC or Jasmine Vallejo​own negligence, except to the extent prohibited by law which may result in injury, death or damages to me or my family, heirs, or assignees.

15. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California.

16. Liability Disclaimer

All training and coaching are undertaken at your own risk.
JDV Fitness LLC and Jasmine Vallejo are not liable for any injury, illness, or adverse effects resulting from participation in training programs.

Terms may be updated periodically — clients will be notified of any material changes.

17. Force Majeure

Company shall not be held liable for delays or failure to perform services due to events beyond its reasonable control, including but not limited to illness, acts of God, platform outages, or emergencies.

18. Confidentiality

Company agrees to keep all client information, progress photos, and personal data confidential unless written consent is provided by Client or disclosure is required by law.
